Terms of Service

The rules of using Timello, written as clearly as we can.

TL;DR — The key points

  • Timello is free to use. A Pro tier is coming, but it won't take away free features.
  • You own your data. We store it only to provide the service to you.
  • Use the app legally and responsibly. Don't try to break or abuse it.
  • You can stop using Timello anytime and request deletion of your data.

Agreement to Terms

By downloading, installing, or using the Timello mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Timello is a time tracking application that allows you to:

  • Track time spent on tasks and projects
  • Organize tasks with tags and categories
  • Generate reports and analytics on your time usage
  • Export data in various formats (PDF, Excel, CSV)

Account Registration

Account Creation

To use the App, you must create an account using one of the supported authentication methods (Google, Apple, or Facebook). You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Account Termination

You may delete your account at any time by contacting us at contact@timello.app. We reserve the right to suspend or terminate your account if you violate these Terms.

User Responsibilities

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App or servers
  • Upload malicious code or attempt to compromise security
  • Use the App to harass, abuse, or harm others
  • Reproduce, duplicate, copy, sell, or resell any part of the App
  • Use automated systems to access the App without permission

Your Content

You retain ownership of all content you create in the App (tasks, descriptions, tags, etc.). By using the App, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

You are responsible for the content you create and represent that:

  • You have the right to create and share such content
  • Your content does not violate any laws or third-party rights
  • Your content is not fraudulent, misleading, or deceptive

Intellectual Property

Our Rights

The App, including its design, features, code, graphics, and all related intellectual property, is owned by Timello and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on the App.

Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without any obligation to you.

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy.

Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF DATA

No Guarantee

We do not guarantee that:

  • The App will be uninterrupted, secure, or error-free
  • Results from using the App will be accurate or reliable
  • Any errors will be corrected
  • The App will meet your specific requirements

Data Loss

While we take precautions to protect your data, we are not responsible for any loss of data. We recommend regularly exporting your important data.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TIMELLO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
  • ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR €100 IF NO PAYMENT WAS MADE)

These limitations apply regardless of the legal theory (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Timello and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the App

Changes to the App

We reserve the right to:

  • Modify or discontinue the App (or any part) at any time
  • Change features, functionality, or pricing
  • Limit certain features or access to parts of the App

We will make reasonable efforts to notify you of significant changes.

Changes to Terms

We may update these Terms from time to time. When we do:

  • We will post the updated Terms in the App
  • We will update the "Last updated" date
  • For material changes, we may provide additional notice

Your continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law and Disputes

Governing Law

These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  1. Informal Resolution: First, contact us at contact@timello.app to attempt to resolve the dispute informally.
  2. Mediation: If informal resolution fails, disputes may be submitted to mediation.
  3. Courts: If mediation fails, disputes shall be submitted to the courts of Poland.

Class Action Waiver

To the extent permitted by law, you agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Timello regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights without restriction.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
